2. Purpose:
House Bill 4198 would amend Part 821, “Snowmobile Law”, of the Natural Resources and Environmental Protection Act, 1994 PA 451, by amending section 82126 (MCL 324.82126) to:
· Edit and clean up the current language in the section.
· Clarify the assumption of risk provision of the law; (6) Lines 12-13.

This legislation will have little or no impact on the current Snowmobile Trail Program.

6. Arguments Against the Bill:
None.
7. Arguments For the Bill:
The current law identifies inherent risks that each person who participates in the sport of snowmobiling accepts insofar as the dangers are obvious and inherent. This legislation attempts to clarify when use of a snowmobile is negligent and, therefore, not part of the definition of an inherent risk.
